Representation at the Court at The Hague
At the request of Senator Borah, the Senate Committee on Foreign Relations adopted a resolution requesting President Harding for further information on his proposal to have the United States represented at the International Court at The Hague. The resolution requests President Harding to inform the committee:
1. Whether the President favors an agreement that would oblige all governments that have signed the protocol establishing an international court of justice to submit to that court disputes that cannot be settled by diplomacy, including the interpretation of treaties and the violation of international obligations, the nature and extent of the reparations resulting therefrom;
2. If Secretary of State Hughes favors such an agreement, would the President please ascertain whether other powers are willing to adhere to it? In other words, are the signatories to the protocol constituting this Court of Justice willing to obligate themselves, in this regard, to submit such questions to the Court, or do they intend to insist only that these questions be submitted to the Court if both adversaries, or all interested parties, agree to refer the matter to the Court after the conflict has arisen?
The White House has declared that the President will not call a special session of Congress on the matter, as he believes immediate action is unnecessary.
The Administration has studied the matter for a year and has made a thorough diplomatic investigation into how to reach the point just reached, that is, the possibility of proposing the participation of the United States subject to certain reservations that may be approved by the Senate.
Congress, which adjourns on Saturday, will not reconvene until December.
